Orchard ("Orchard," "we," "us") provides workforce monitoring, business intelligence, and automation for organizations. This policy explains what information we collect from visitors to entertheorchard.ai and people who join our mailing list, how we use it, and the choices you have.
We collect information to run the site, understand its use, respond to inquiries, and send updates when you ask for them. Monitoring data processed by the Orchard product is covered separately in our Data Processing Agreement.
1. Information we collect
Information you give us. When you request a briefing, we collect the information requested by the form, such as your name, work email, and selected topic, along with the submission time, source page, and a submission identifier. We use these details to respond to your inquiry. You can also book directly through links to our Google Calendar booking page, without submitting an inquiry form here. Google hosts that page and receives the appointment information you provide under its privacy terms.
The current landing page does not have a mailing-list signup form. If you previously joined our mailing list, we retain your email address and subscription preferences as described below. The unsubscribe page accepts an email address so we can process an opt-out request.
Optional analytics. If you allow Analytics in our privacy preferences, we use Google Analytics 4 to understand how people find and use the site. It collects usage information such as page views, sessions, referral information, approximate location, browser and device information, screen resolution, scrolling, outbound clicks, site-search activity, file downloads, video engagement, and form interactions. We do not send your name, email address, or other directly identifying information to Google Analytics.
Google Analytics uses first-party cookies, including _ga and a property-specific _ga_* cookie, to distinguish browsers and sessions. Google may use an IP address during collection for routing, security, and approximate location; Google states that raw IP addresses are not associated with user identifiers and are discarded after use.
Microsoft Clarity. With the same Analytics permission, we use Microsoft Clarity heatmaps and session recordings to understand navigation, clicks, scrolling, and where visitors encounter difficulties. Clarity processes page content and interaction, browser, device, and session information, including visited URLs and referral information. We mask the contents of our website forms in recordings and do not use Clarity's identify API to attach your name or email address to a session. Masking is not a guarantee that every type of personal information is excluded; please do not include sensitive information in page URLs.
Clarity uses cookies, including _clck and _clsk, to associate browser visits and session activity. We load Clarity only after you allow Analytics and send its advertising-storage consent as denied. Microsoft processes this information under its Privacy Statement.
Analytics information is not attached to your briefing request or mailing-list submission in our systems.
Website hosting and operational records. Cloudflare hosts this website and its form endpoints. Hosting and infrastructure providers receive standard request metadata, including IP addresses, browser information, and requested URLs, to deliver and protect the site. We use request and error records to operate the website and diagnose failures. Our form handlers do not intentionally write submitted contact details or provider response bodies to application logs.
Local browser storage. The site uses localStorage to remember your colour-theme preference. Our self-hosted consent manager stores an orchard_consent cookie for 182 days, containing your chosen categories, a consent identifier, policy version, language, and choice timestamps. This record stays in your browser; we do not maintain a separate server-side consent audit log. Optional Google Analytics and Microsoft Clarity remain off until you allow Analytics. We ask for a new choice when the consent settings materially change.
2. How we use information
- To send product updates you requested and manage your subscription preferences
- To respond to inquiries and arrange the briefings you request
- To process unsubscribe requests, protect our services from abuse, and diagnose request failures
- To understand site traffic and visitor interactions, identify usability problems, and improve the website
- To comply with applicable law
We do not use your personal information to train third-party AI models.
3. Where your information lives
We use Resend to deliver briefing requests to the Orchard team by email. These notifications include the information submitted in the form and may remain in our business email system while we manage your inquiry. A briefing request does not subscribe you to our mailing list. For existing mailing-list subscribers, Resend also stores contact and subscription information and processes subscription changes.
Our legacy signup service uses Web3Forms as a fallback when Resend is unavailable. It receives a submitted email address only when that fallback is used; the current landing page does not submit signup requests.
The site and its form endpoints are hosted on Cloudflare, which processes request metadata as described above.
Third parties we currently use:
- Resend — delivery of briefing requests and management of existing email subscriptions
- Web3Forms — backup delivery of signups when Resend is unavailable
- Cloudflare — website hosting, request handling, and operational logs
- Google Analytics — measurement of website traffic and interactions
- Microsoft Clarity — heatmaps and session recordings to understand website use
- Google Calendar — appointment booking, reached directly or after an inquiry
Website fonts are served with the site; the page does not request them from Google Fonts.
4. How long we keep it
We keep your email address in Resend for as long as you remain on the mailing list, or until you unsubscribe or ask us to delete it. We retain inquiry and appointment information as needed to respond and manage the relationship, subject to deletion requests and applicable retention requirements. Google Analytics data is retained according to the retention controls configured for our Analytics property. Microsoft Clarity retains analytics and recordings according to its service retention settings and policies.
5. Your choices and rights
Choose “Reject optional” to use the site without Google Analytics or Microsoft Clarity. You can revisit “Privacy choices” on any page to change or withdraw permission. Withdrawing permission sends a denial to the analytics providers, clears known first-party Analytics cookies, and reloads the page to stop their running scripts. It does not delete information already received by a provider. Your choice applies to this browser; clearing its cookies or using another browser requires a new choice.
You can ask us to:
- Show you what we hold about you
- Correct anything that's wrong
- Delete your email address from our list
- Stop sending you updates
Every email we send also carries an unsubscribe link, which removes you without needing to write to us. Otherwise, email cooper@myorchard.ai from the address you signed up with and we'll handle it — usually within a few business days. Depending on where you live (EEA, UK, California, and others), you may have additional rights under GDPR, the UK GDPR, or the CCPA / CPRA, including the right to lodge a complaint with your local data protection authority.
6. Security
We take reasonable measures to protect the data we collect, including TLS in transit and access controls on the systems that store it. No method of transmission or storage is perfectly secure, so we can't promise absolute security — but we don't collect more than we need, which is the best protection we can offer.
7. Children
The site and our mailing list are intended for business users. We do not knowingly collect information from children under 16.
8. International transfers
We are based in the United States, and our service providers (Resend, Web3Forms, Cloudflare, Google Analytics, Microsoft Clarity, Google Calendar) operate globally. If you submit information from outside the United States, you understand that it may be processed in the United States and other countries where data protection laws may differ from those in your jurisdiction.
9. Changes to this policy
We'll update this page when our practices change. The "last updated" date at the top will always reflect the current version. Material changes will be communicated to people on our mailing list before they take effect.
10. Contact
